General Terms and Conditions – Trade Fair

Conditions of participation for exhibitors at the virtual energy fair meetingpoint.energy

The rental of virtual exhibition stands is regulated. Additional services provided within this framework are also subject to these conditions of participation. The participants confirm that by participating in the energy trade fair meetingpoint.energy (hereinafter referred to as “meetingpoint.energy”) as an exhibitor you are pursuing commercial objectives and that you are entering into this agreement in your activity as an entrepreneur (hereinafter referred to as “participant”) with the organiser Lorbach Communication GmbH (hereinafter referred to as “Lorbach GmbH”).

The concrete description of services results from these conditions of participation and the details in the registration form. Offers made by Lorbach GmbH in response to enquiries are subject to change and non-binding.

meetingpoint.energy is organised by Lorbach GmbH and will take place on the Internet from 21 to 25 June 2021.

1. Conclusion of the agreement

1.1    By sending the fully completed registration form, electronically or scanned, the exhibitor orders a virtual exhibition stand and associated service options in accordance with the service descriptions of the booked package.

1.2    The meetingpoint.energy conditions of participation are bindingly accepted by the exhibitor with the online registration. The application is binding for the exhibitor. The contract between the exhibitor and Lorbach GmbH shall come into effect with the transmission of the order confirmation.

2. Services of the Lorbach GmbH

2.1    After conclusion of the contract, the exhibitor will receive a down payment invoice amounting to 100% of the booked services, variable costs such as the lead fee excluded. After settlement of this invoice, the Exhibitor will receive access to his virtual exhibition stand from June 1st 2021. By sending the access data he can use the platform from the beginning of the event on 21 June 2020 until 01 June 2022. The Exhibitor can fill and design his virtual trade fair stand independently at any time as required. The allocation of the position of the virtual exhibition stand in the virtual exhibition area and in the exhibition catalogue is carried out by Lorbach GmbH, special placement requests of the Exhibitor will be considered if possible. The Exhibitor has no claim to a specific placement of the virtual exhibition stand.

2.2    After conclusion of the contract the exhibitor receives the following services from Lorbach GmbH:

  • Provision of the virtual exhibition stand from June 1st 2021 up to and including 31.05.2022. Individually created stands can also be used up to 31.05.2022. The prerequisite is the settlement of the invoice received
  • The monthly fair rates are valid from the first day of each month until the last day of the month. With the beginning of the first day of a following month, a new monthly instalment must be paid.
  • Neutral editable stand templates for the design of the trade fair stand in the corporate design
  • Integration of a contact form at the virtual exhibition stand
  • Access to the Portal of Energy networking platform until 31.05.2022, after which the platform can continue to be used for a fee (for companies) and free of charge (for individuals). If exhibitors continue using the platform, they need to conclude a contract with the owner of this platform – AVACO GmbH.

Further services are offered by Lorbach GmbH for a fee.

2.3    Insofar as other additional services are booked by the Exhibitor, the concrete scope of the service shall be based on the details in the confirmation of registration.

2.4    The exhibitor must ensure at his own expense that he meets the technical requirements for his participation in meetingpoint.energy.

2.5    After receipt of the order confirmation, the exhibitor will be informed by e-mail at a later date about further details of the preparation and implementation of the virtual trade fair. Information on the organisation is also available on the website www.meetingpoint.energy.

3. Performance obligations of the exhibitor for filling and operating the virtual stand

3.1    The exhibitor bears the sole responsibility for all contents of his virtual trade fair stand, be it texts, graphics, videos, links or catalogue entries, not to infringe the rights of third parties. He shall indemnify Lorbach GmbH against any claims of third parties arising from the execution of the order, even if it is cancelled.

Lorbach GmbH is not obliged to check entries and contents to see whether they infringe the rights of third parties or whether they comply with competition law. Should third parties assert claims against Lorbach GmbH due to the legal or competition law inadmissibility of the entry, the exhibitor shall indemnify Lorbach GmbH from all claims asserted including all costs of necessary legal defence on first demand.

3.2    The exhibitor is aware that the staffing of the live chat at his virtual trade fair stand with at least one competent employee during the duration of the actively staged trade fair from 21 to 25 June 2021  in the time between 10:00 a.m. and 6:00 p.m. (CET) is necessary for the success of the trade fair and the generation of leads. During this time, enquiries from visitors should be answered directly.

3.3     The exhibitor permits Lorbach GmbH to use the company logo and the information and media provided by him within the framework of meetingpoint.energy for the purpose of advertising measures for this and future events.

4. Registration confirmation, cancellation of participation in the exhibition

4.1    The exhibitor may withdraw from his participation free of charge up to 14 days after receipt of the confirmation of registration without giving reasons. Lorbach GmbH must be notified of the withdrawal in writing. A processing fee of € 90.00 plus statutory value added tax shall be due.

4.2    If an economic realisation of meetingpoint.energy is impossible due to insufficient numbers of participants or force majeure, Lorbach GmbH may withdraw from the contract and cancel the event. Lorbach GmbH will then inform the participants immediately and refund any participation fees already paid, less a processing fee of € 90.00 plus VAT at the statutory rate.  Any further claims of the participant are excluded unless Lorbach GmbH is guilty of intent or gross negligence.

4.3    If the meetingpoint.energy trade fair must be cancelled due to unforeseeable force majeure, the participants shall bear their own costs incurred up to this point in time.

4.4    If the exhibitor cancels after the registration confirmation, the following cancellation conditions apply:

  • up to 14 days after registration free cancellation with a handling fee of 90,00 €.
  • until 26.02.2021 50% of the costs for the firmly booked services are due
  • from 27.02.2021 100% of the costs for the firmly booked services are due
5. EU DSGVO – Google Analytics

5.1    Within the framework of meetingpoint.energy the contracting party collects personal data of the visitors – thus the exhibitor is subject to the obligations of the EU DSGVO and must conclude an agreement with Lorbach GmbH on order processing in accordance with Art. 28 DSGVO. A corresponding agreement will be sent to the contracting party with the confirmation of registration.

6. Payment and due date

6.1    All prices quoted are net prices and do not include the statutory value added tax.

6.2    The invoice amount is due 10 days after receipt of the invoice without deduction. If the exhibitor is in default of payment, Lorbach GmbH shall be entitled to claim default interest at a rate of 6 % p.a.

6.3    Immediately after settlement of the down payment invoice, the Exhibitor will be granted access to the Fairsnext platform where he can manage his virtual stand.

6.4    Completion of the virtual exhibition stand by the exhibitor.

The exhibitor confirms that he/she will design his/her virtual exhibition stand graphically and upload it filled with content to the meetingpoint.energy exhibition platform by 20 June 2021. Lorbach GmbH reserves the right to deactivate the exhibitor’s virtual trade fair stand in the event of a delay and failure to fill it.

7. Miscellaneous

7.1    Lorbach GmbH reserves the right to make changes and additions concerning the technical platforms and data protection.

7.2    This contract and all obligations arising from it are subject to German law. Place of jurisdiction and place of performance is Berlin. Should individual provisions of these conditions of participation or a provision within the framework of other agreements be or become invalid in whole or in part, this shall not affect the legal validity of the remaining provisions. They shall be replaced by an appropriate provision that most closely approximates the intention of the invalid or missing provision.

A visit to the virtual trade fair is regulated. Visitors confirm that they are pursuing commercial objectives as visitors by participating in meetingpoint.energy and that they are entering into this agreement in their capacity as entrepreneurs (hereinafter “participant”) with the organiser Lorbach Communication GmbH i.G., 10439 Berlin (hereinafter “Lorbach”).

The concrete description of services results from these conditions of participation and the details in the registration form. Offers made by Lorbach in response to enquiries are subject to change and non-binding.

Meetingpoint.energy is organised by Lorbach GmbH and will take place on the Internet from 21 to 25 June 2021.

1. Conclusion of the agreement

1.1    The participant books his/her fair ticket by sending in the fully completed electronic registration form.

1.2    The meetingpoint.energy conditions of participation are bindingly accepted by the participant with the online registration. The registration is binding for the participant. The contract between the participant and Lorbach is concluded with the transmission of the order confirmation.

2. Services of the Lorbach GmbH

2.1    The participant will receive access to the virtual fair after conclusion of the contract. By sending the access data (via registration form) , he/she can enter the 3D-fair for the booked duration of the event.

2.2    After conclusion of the contract, the participant receives the following services from Lorbach, which are summarised as follows:

  • Free movement through the 3D fair
  • Dashboard with navigation options, match list, calendar
  • Convenient booking of appointments with the exhibitor
  • Depending on availability, the possibility to participate in tastings
  • Text or video chat functions

2.4    The participant must ensure at his/her own expense that he/she meets the technical requirements for his/her participation in meetingpoint.energy.

2.5    After receipt of the order confirmation, the participant will be informed at a later date by e-mail about further details of the preparation and implementation of the virtual trade fair. All information on the organisation is also available in the participants’ area on the website www.meetingpoint.energy.

3. Performance obligations of the participant 

3.1    Die meetingpoint.energy ist vorrangig Fachbesuchern vorbehalten. Der/die TeilnehmerIn hat alle relevanten Kontaktdaten im Profil anzugeben.

9.2    After conclusion of the contract, the participant receives the following services from Lorbach, which are summarised as follows:

  • Free movement through the 3D fair
  • Dashboard with navigation options, match list, calendar
  • Convenient booking of appointments with the exhibitor
  • Depending on availability, the possibility to participate in tastings

9.4    The participant must ensure at his/her own expense that he/she meets the technical requirements for his/her participation in meetingpoint.energy.

10. Performance obligations of the participant 

10.1    The meetingpoint.energy is primarily reserved for trade visitors. The participant must provide all relevant contact details in the profile.

11. Registration confirmation, cancellation of participation

11.1    The participant may withdraw from his participation free of charge up to 14 days after receipt of the confirmation of registration without giving reasons. The withdrawal must be notified to Lorbach in writing. A processing fee may become due

11.2    If an economic realisation of meetingpoint.energy is impossible due to insufficient numbers of participants or force majeure, Lorbach may withdraw from the contract and cancel the event. Lorbach will then inform the participants immediately and refund any participation fees already paid in full.  Any further claims of the participants shall be excluded unless Lorbach is guilty of intent or gross negligence.

11.3    If meetingpoint.energy has to be cancelled due to unforeseeable force majeure, the participants shall bear their own costs incurred up to this point in time.

12. EU DSGVO – Google Analytics

12.1    Within the framework of meetingpoint.energy the contracting party collects personal data of visitors – thus the participants are subject to the obligations of the EU DSGVO and must conclude an agreement with Lorbach on order processing in accordance with Art. 28 DSGVO.

13. Payment and due date

13.1    All prices quoted are net prices and do not include the statutory value added tax.
